The website https://www.peaceofmindmadrid.com/, a platform specialized in luxury apartment rentals in Madrid, is managed by PEACE OF MIND PROPERTY MANAGEMENT MADRID S.C., who makes it available to users (hereinafter, the “Users”) to facilitate contact with property owners and handle the necessary procedures for the rental of exclusive properties. In accordance with current legislation in Spain, we provide our identification and contact details below.

Access to the website

Access to the website is free of charge, except for the cost of the connection through the telecommunications network provided by the User’s Internet service provider, and implies full acceptance of these general terms of use, which the User declares to understand completely.

As a general rule, prior registration is not required to access the informational content of the website.

Conditions of Use for Browsing and Accessing the Website (hereinafter, the “Conditions of Use”)

Use of the website constitutes full acceptance by the User of these conditions. If the User does not agree with the content, they must refrain from using the website and its services.

The Owner reserves the right to make any changes deemed appropriate, including modifying, deleting, or adding new content and/or services without prior notice, as well as altering the way they are presented or located and the terms of use of the website.

The Owner assumes no responsibility for third-party hyperlinks on the website leading to content outside the site. However, the Owner will remove links to unlawful content as soon as it becomes aware of them.

If a legal entity: company name, address, and legal representative; (iii) the name and address of the recipient or, if a legal entity, their corporate name and registered address; (iv) a description of the disputed content and its specific location; (v) the legal grounds and justifications for removal, including applicable law and facts; and (vi) a copy of prior correspondence requesting withdrawal, removal, or modification of the content, or an explanation of why contact was not possible..

Minors

Concerning the use of the website by minors, it is noted that the Owner cannot control whether children under the age of 14 access and use the website. Therefore, the Owner assumes no liability in this regard and informs parents and guardians that they are solely responsible for monitoring and assisting minors in browsing the website and enabling any necessary mechanisms to restrict their access.

Should any services be specifically intended for minors, the Owner will request the consent of parents or legal guardians for the collection and processing of personal data.

Links

Access keys or similar

In the event that any service on the website includes access keys or usernames, the User shall choose and indicate their own access keys (username, registration, password, password, or similar), not being able to choose for them words, expressions, or graphic-denominative sets that are offensive, insulting, coinciding with trademarks, trade names, signs, corporate names, public expressions, names and pseudonyms of publicly relevant or famous people for whose use they are not authorized, and, in general, contrary to the law or to the demands of morality and generally accepted good customs.

Intellectual and Industrial Property

The User acknowledges that all contents of the website and, specifically, all information and materials, the structure, selection, arrangement, and presentation of its contents, programs and application development used in relation to them, are protected by intellectual and industrial property rights owned by the website owner or, where appropriate, third parties.

In no case shall access to or use by the User imply any type of waiver, transfer, or total or partial assignment of said rights, nor shall it confer any right of use, alteration, exploitation, reproduction, distribution, or public communication of said contents without the prior and express authorization specifically granted for that purpose by the Owner or the third party holder of the affected rights.

The Owner is the proprietor of the elements that make up the graphic design of the website, menus, navigation buttons, code, texts, images, textures, graphics, and any other content on the website or, in other cases, has the corresponding authorization for the use of said elements.

In the event that any User or a third party considers that any of the contents has been entered on the website in violation of their Intellectual or Industrial Property rights, they must send a notification to the Owner identifying themselves and the holder of the allegedly infringed intellectual or industrial property rights, providing the title or accreditation of the representation of said rights.

The Owner assumes no responsibility for the information contained on third-party websites that can be accessed through “links” or hyperlinks from any website owned by the Owner. Applicable Law and Jurisdiction

These Terms of Use shall be governed by the provisions of Spanish legislation.

In the event of a dispute regarding the interpretation, execution, or termination of these conditions, and without prejudice to the User being able to resort at any time to the assistance of the Courts of Justice and other competent Administrations, the parties shall attempt, without obligation, to resolve it amicably. If no agreement is reached, an optional mediation procedure may be offered and accepted voluntarily, carried out loyally and in good faith in order to reach an amicable agreement when any conflict related to this contract arises, including its validity.

The party wishing to implement the mediation process must inform the other party in advance by registered letter with acknowledgment of receipt, indicating the elements of the dispute. Since mediation is not mandatory, the consumer User or the Owner may not participate or may withdraw from the mediation process at any time. In the event that mediation fails or is not considered, the dispute that may have given rise to the mediation may be referred to the competent court or tribunal.

In the event of a dispute or controversy related to the application or interpretation of these conditions, the Parties shall submit to the Spanish Courts and Tribunals that are territorially competent in accordance with the current legislation.
